First order 

12-2020

This was written by an administrative law judge after 50 hours of testimonies. LCSD was ordered to fund Latham Centers.

Our attorneys felt the judge made an error and appealed the order to the Ninth Circuit Court of Appeals.

Injunction filed

02-2021

LCSD refused to follow the order. Our attorneys filed an injunction in federal court to enforce the funding and order.

10-2021

Three appellate judges decided the federal judge made an error and again ordered LCSD to fund Latham Centers. LCSD filed for en banc, continuing to not fund Latham Centers.

The federal judge ruled LCSD met the criteria from order and did not enforce the injunction.

9th Circuit final order

12-2021

The appellate court denied en banc and mandated LCSD to fund Latham Centers immediately. This form of action is not typical. They realized the need for Sequoia to be there as soon as possible. 

 Now,
Lincoln County School District
is suing Sequoia. 

After all the litigation and orders that support Sequoia's need to be at Latham Centers they continue to fight the funding without ever appealing the original order.

 This is at the expense of tax payers money.
